DESCRIPTION

This act describes the powers of the board of hospital trustees (the board). Section 205.190 delineates qualification and organization requirements of the board. The board may make rules and regulations and will control the hospital fund, with exceptions. In addition, the board will be responsible for purchase, construction, or lease of hospital grounds, rooms, or buildings.

Except in counties of the third or fourth classification where an organized hospital already exists, the trustees will have authority to operate, maintain, and manage the hospital and facilities. However, any lease of substantially all of the hospital may be entered into only upon approval of the county commission, which has the authority to separately negotiate and enter into contractual agreements with the lessee as a condition of approval of the lease.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
