FISCAL ANALYSIS

ASSUMPTION

The Department of Health, Office of State Courts Administrator, and State Public Defender's Office assume this proposal would not fiscally impact their agencies.

The Attorney General's Office (AGO) and the Office of Prosecution Services (OPS) did not respond to our fiscal impact request. However, in responses to similar proposals, AGO and OPS assumed no fiscal impact on their agencies.

The Department of Corrections (DOC) states they cannot predict the number of new commitments which may result from the creation of the offense(s) outlined in this proposal. An increase in commitments depends on the utilization by prosecutors and the actual sentences imposed by the court. If additional persons are sentenced to the custody of the DOC due to the provisions of this proposal, the DOC will incur a corresponding increase in operational costs either through incarceration or through supervision provided by the Board of Probation and Parole. Supervision by the DOC through probation or incarceration would result in some additional costs but it is assumed that the impact would be minimal.

Oversight further clarified with DOC that they expect to be able to absorb any additional costs resulting from this proposal within current appropriation levels.

Small businesses would be expected to be fiscally impacted to the extent that they would perform less procedures due to the requirements of this proposal.


DESCRIPTION

This proposal prohibits partial birth abortion. The proposal contains definitions of "born", "partially born" and "serious physical injury"; prohibits partial birth abortions as infanticide, unless necessary to preserve the life of or prevent serious physical injury to the mother; prohibits prosecution of the mother; and provides that infanticide is a Class A felony.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
