Officials of the Department of Public Safety - Division of Fire Safety assume this proposal would have no fiscal impact to their agency.

No direct fiscal impact to small businesses would be expected as a result of this proposal.


DESCRIPTION

This proposal would designate the State Fire Marshal or his staff as peace officers, if they are certified as such. Current language requires 240 hours of police training, and limits this designation to circumstances where the fire marshal or staff is being assaulted.

The power of the fire marshal and staff to arrest upon notification of the existence of the investigation to the county sheriff or chief of police would be expanded to all offenses incident to the investigation connected with their duties. Current language limits the arrest power to fire related offenses and only when investigating such offenses.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
