FISCAL ANALYSIS

ASSUMPTION

The Office of the State Courts Administrator and Office of the Attorney General assume the proposed legislation would have no fiscal impact on their agencies.

The Office of the State Public Defender (SPD) assumes that if the proposed amendment passes, the subsequent legislation that could follow would have a great fiscal impact on the SPD system. Investigations would have to be done into old crimes, many of which may not have been prosecuted or ever charged, including but not limited to a rash of depositions and other investigations, perhaps costs in dealing with repressed memories or other issues involving very old crimes and supposed victims who may not have come forward before. SPD assumes costs could easily exceed $100,000.

Advertisement costs for the proposal would be $3,990 per newspaper column inch for three publications of the text of the proposal, the introduction, title, fiscal note summary, and affidavit. The proposal would be on the ballot for the November 2000 general election.

No direct fiscal impact to small businesses would be expected as a result of this proposal.


DESCRIPTION

This proposed constitutional amendment allows admissible evidence of previously charged and uncharged crimes to be considered in criminal indictments or information.

This legislation is not federally mandated, would not duplicate any other program, and would not require additional capital improvements or rental space.
