HB 358 -- VICTIM NOTIFICATION OF HIV TEST (Hosmer) This bill requires the Department of Corrections to notify a parent or guardian of a child who is a victim of a sexual offense that has intercourse as an element of the offense if the offender has a confirmed positive HIV test. FISCAL NOTE: No impact on state funds.
HB 358 -- VICTIM NOTIFICATION OF HIV TEST SPONSOR: Hosmer COMMITTEE ACTION: Voted "do pass by consent" by the Committee on Public Health by a vote of 10 to 0. This bill requires the Department of Corrections to notify a parent or guardian of a child who is a victim of a sexual offense that has intercourse as an element of the offense if the offender has a confirmed positive HIV test. FISCAL NOTE: No impact on state funds. PROPONENTS: Supporters say that the intent of this bill is to notify a parent or guardian of an unemancipated minor who is a victim of a sexual offense that has intercourse as an element of any confirmed positive HIV test on an offender under custody of the Department of Corrections.
