SCS HB 779 -- VACATION OF STREETS AND EASEMENTS

This bill allows the county commission to vacate public
easements outside incorporated areas by petition of the owners
of the ground lying on both sides of the easement.  Proper
notice must be given of such vacation.  Under current law, such
vacations are allowed for streets, avenues, roads, alleys, and
public squares.  Utility companies that provide service in the
area of the vacation must be notified of a petition to vacate.
If the county commission orders the requested vacation, the
order must be filed with the county recorder of deeds.

on Local Government and Related Matters by a vote of 17 to 0.
