Officials of the Department of Natural Resources assume no fiscal impact.



Oversight assumes this proposal would allow certain cities to have a legal remedy to rid their cities of derelict vehicles. Oversight assumes this proposal is enabling legislation and would have no fiscal impact without action by the governing body or it's representatives. Oversight assumes if the city were to clean the property, they would be reimbursed of all cost of clean-up by the property owner. Oversight assumes no fiscal impact to local governments.



The Cities of Hazelwood and Liberty did not respond to this proposal.

FISCAL IMPACT - Small Business



Small businesses located in the Cities of Hazelwood or Liberty, that would have derelict vehicles located on their property that has been declared a public nuisance by the City, and after notice have not cleared the property of the derelict vehicles, could expect to have the vehicles removed at their expense.



DESCRIPTION



Under this act, the owner of any property located within any home rule city having a population of more than 26,200 but less than 26,300 inhabitants who permits derelict vehicles to remain on his or her property shall be liable for the removal of the derelict vehicles if they are declared a public nuisance.

This act shall not apply to agricultural or horticultural property, property containing any licensed vehicle service or repair facility, or to property in which the derelict vehicle is enclosed in a permanent structure designed for vehicle storage. To declare the derelict vehicle to be a public nuisance, the governing body of the city shall give a hearing upon 10 days notice. At the hearing, the governing body may declare such vehicles to be public nuisances and order them abated within 5 days. If the nuisance is not abated within such time period, the governing body shall have the nuisance abated and assess the cost of the removal to the owner.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
