FISCAL ANALYSIS



ASSUMPTION



Timing would not permit a response from the cities of Claycomo, or Liberty.



Oversight assumes this proposal is enabling legislation. A property owner who owns a piece of contguous property that is located in two cities would be allowed to detach his property from one city and annex it to the other city. If the city to where the property is being attached is a village, the governing body would be required to place the question of annexation to a vote of the citizens. If the city were not a village, but a charter city, the city would annex under the provisions of it's charter. Oversight assumes if the one city were a village there would be the cost of an election, however, it is not known if a citizen would choose to detach their property. Oversight assumes if this were to occur the city from which the property is being detached would lose the assessed value or property taxes generated by the property. The annexing city would realize an addition of property tax. Oversight is not able to determine if either city's voters would approve either detaching the property or annexing the property. Because this is enabling legislation Oversight assume no local fiscal impact. Oversight assumes no state fiscal impact.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION



This act enables any property owner who owns a contiguous parcel of land that is situated in both the city of Liberty and the city of Claycomo to choose to detach such property from one city and annex such detached portion to the other city. Where the city to which the property is being attached is a village, the governing body shall adopt an ordinance and submit the issue of annexation to a vote of the people. Where the city to which the property is being attached is a charter city, the city shall proceed with annexation under the provisions of its charter. Following annexation, the annexing body shall notify the other city of the annexation.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
