FISCAL ANALYSIS



ASSUMPTION



Officials of the Department of Elementary Education, the Department of Revenue, the Department of Social Services stated the proposal would not affect their agencies directly.



Officials of the State Courts Administrator would expect some test cases exploring the parameters of the proposal but does not anticipate any material effect on the workloads of Missouri courts.



Advertisement costs for the proposal would be $4,380 per newspaper column inch for three publications of the text of the proposal, the introduction, title, fiscal note summary, and affidavit. The proposal would be on the ballot for the November 2000 general election.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.





DESCRIPTION



This proposal would revise sections 5 and 7 of article I of the state constitution. Section 7 currently forbids use of public money, directly or indirectly, in aid of any religion or cleric or teacher of religion. This proposal would eliminate the reference to teachers. Section 5 would forbid the state from making any law respecting establishment of religion or prohibiting the free exercise of religion.

The proposal would also revise Section 8 of article IX by removing the provision forbidding state or local governments from appropriating money or paying for anything in aid of or helping to support religious schools.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space. The proposal would not affect Total State Revenue.
