ASSUMPTION
Officials from the Office of the State Courts Administrator, Department of Elementary and Secondary Education, Department of Corrections, and Office of the Attorney General assume the proposed legislation would have no fiscal impact on their agencies.
Officials from the Department of Public Safety (DPS) assume the cost of the proposed legislation is unknown. DPS does not anticipate any actions taken against their agency by an aggrieved party. However, should a case be filed, DPS will request through normal budget procedures, funds to pay the fine.
Officials from the Office of Prosecution Services (OPS) assume the proposed legislation could have a fiscal impact on local prosecuting attorneys. OPS could not estimate the fiscal impact as it would depend on the number of cases filed against public employees and whether the court assessed the fine put forth in the proposal.
Oversight assumes the amount of fines assessed by the courts against public employees would be less than $100,000 per year.

No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
The proposed legislation allows courts to assess a fine not to exceed $5,000 per incident against any public employee who flagrantly and knowingly fails to enforce the rights of a crime victim.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
