ASSUMPTION
Officials from the Department of Revenue, Division of Motor Vehicle and Drivers Licensing stated they could not determine the number of God Bless America plates that will be requested. This will have an unknown impact on their agency.
The provisions of this proposal authorize a specialized God Bless America license plate. Each applicant must pay an additional $10 fee for the plate; however, the way this proposal is worded it indicates that this would be deposited in the World War II Memorial Trust Fund. This proposal will have an impact on revenue; however, because the MVB does not know the number of individuals who will apply for this special plate, the revenue increase cannot be determined.
This will have an unknown revenue increase. Constitutionally an increase in motor vehicle fees would have to be distributed as indicated in Article IV, Section 30(b) and could not be deposited in the World War II Memorial Trust Fund.
To implement this legislation, the Department of Revenue will require additional funds. In the past, the programs included in this legislation have been paid for with highway funds. This year, however, highway funds may not be available for this purpose as a result of legislation enacted by the General Assembly in 2000 that limits the use of highway funds.
If highway funds are not available, then another source of funding must be identified to pay for the cost of implementing this legislation.
In response to earlier versions of this proposed legislation, officials from the Department of Highway and Transportation state they were unable to provide an estimate for this proposal. Therefore, they must rely upon the DOR for their response.
In response to earlier versions of this proposed legislation, officials from the Secretary of State's Office (SOS) stated this bill creates a personalized "God Bless America" license plate and creates a WWII Memorial Trust Fund to be established by the Department of Revenue. Based on experience with others divisions, the rules, regulations and forms issued by the Department could require as many as approximately 12 pages in the Code of State Regulations. For any given rule, roughly one-half again as many pages are published in the Missouri Register as are published in the Code because of cost statements, fiscal notes and notices that are not published in the Code. The estimated cost of a page in the Missouri Register is $23.00. The estimated cost of a page in the Code of State Regulations is $27.00. The actual costs could be more or less than estimated. The impact of this legislation in future years is unknown and depends upon the frequency and length of rules filed, amended, rescinded and withdrawn. The SOS estimates the cost of this legislation to be $738. [12x$27) + (18x$23) = $738]
Oversight assumes the SOS could absorb the costs of printing and distributing regulations related to this proposal. If multiple bills pass which require the printing and distribution of regulations at substantial costs, the SOS could request funding through the appropriation process. Any decisions to raise fees to defray costs would likely be made in subsequent fiscal years.

FISCAL IMPACT - Small Business
No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
This act creates the "God Bless America" license plate. Any person desiring such a plate shall pay $10 in addition to regular registration fees. The $10 fee shall be deposited in the WWII Memorial Fund.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
