FISCAL ANALYSIS



ASSUMPTION



Officials from the Department of Public Safety - State Highway Patrol (MHP) assume the Highway Patrol's Training Academy will not be involved in the course of instruction required for certification. Therefore, the MHP anticipates no fiscal impact.



Officials of the Department of Public Safety (DPS) assume this proposal would add new duties to their department. DPS assumes the POST Commission would be required to conduct a job task analysis to determine a course of instruction for corrections officer certification, and would certify Correction Officers. DPS assumes they would need 5 FTE as follows:



2 FTE Clerk Typists III (each at $23,184 plus fringe benefits, equipment and expense) to assist with the duties associated with the POST Commission and to certify Corrections Officers; 1 FTE Investigator II (at $37,488 plus fringe benefits, equipment and expense) to investigate and determine officers that are in violation of regulations for officers; 1 FTE Program Specialist (at $40,716 plus fringe benefits, equipment and expense) to oversee and implement certification for officers within the POST program; and 1 Program Representative II (at $36,012 plus fringe benefits, equipment and expense) to assist in the implementation of the certification of Corrections Officers. The POST program licenses Peace Officers and the cost is based on doing the same for Corrections Officers based on the requirement of the bill. DPS assumes they would need to rent office space to house the 5 new FTE. Officials estimated annual rental costs at $13,500. Officials estimate the cost of personnel, fringe benefits, equipment and expense at $376,258 for 10 mo. of FY 2003; $284,910 in FY 2004; and $290,573 in FY 2005.



Officials of the Department of Corrections stated that they are unsure what modifications and enhancements to the current training program would be required due to passage of this proposal. Officials assume this would depend on mandates from the POST Commission.



The DOC hosts 60 to 72 training classes per year. DOC costs could prove to be minimal and absorbable if it were decided by the commission that the existing training program would not be altered, however even an 8-hour change in the current curriculum (due to the number of classes held) would result in costs in excess of $100,000 per year.



In summary, the fiscal impact to DOC is potentially assumed to be significant or in excess of $100,000.



Officials from the Lincoln County Sheriff's Department, Adair County, and the Taney County Sheriff's Department stated they are unable to determine the cost of the proposed legislation without further clarification.

Officials from Pettis County assume the proposal would not have a cost unless certification for all jailers would be required.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.





DESCRIPTION



The proposed legislation would add a Department of Corrections member and a corrections association member to the Peace Officer Standards and Training Commission (POST). The proposal would also create a "Corrections Officer Certification Program" that would be designed and established by POST. After July 1, 2003, corrections officers would be designated POST certified corrections officers (CCO) upon successful completion of the training program. By completing this certification course, corrections officers would be eligible for promotion and pay increases after July 1, 2003. Corrections officers employed on or before July 1, 2003, would be certified corrections officers.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space. This legislation would not affect Total State Revenue.
