SB 1050 - Current law provides that in forcible entry and detainer actions, and actions involving rent and possession, applications for a trial de novo or appeal shall not stay execution for restitution unless the defendant gives a bond to secure the damages obtained in the judgment. This act provides that the bond must be a cash bond, which may be remitted to the court in the form of cash, a money order, or certified check. This act is identical to SB 537 (2005). ALEXA PEARSON
